Terms of Service

1. Acceptance

By accessing or using Datachaser, you accept these Terms. If you use the service on behalf of a company, you represent that you have the authority to bind it.

2. Service

Datachaser offers a SaaS service for extraction, enrichment, attribute inference, entity linking, automation, and agents through UI, APIs, and connectors.

3. Account and Security

You are responsible for the security of your credentials and all activity on your account.

4. Plans, Payments, and Renewals

  • Payments processed by Stripe.
  • Automatic renewal unless cancelled.
  • No refunds except by legal obligation or written agreement.
  • We may suspend for non-payment, abuse, or security risks.

5. Acceptable Use (prohibitions)

Prohibited:

  • circumvent limits, authentication, or security measures;
  • reverse engineer the service (unless permitted by law);
  • illegal use, malware, phishing, intrusion, doxxing, or privacy violation;
  • process sensitive data (e.g., health, biometric, minors) without written agreement;
  • use the service to build a direct competitor through misuse of the service/documentation.

6. Customer Data and Licenses

The customer retains ownership of their Customer Data.

The customer grants Datachaser a worldwide, limited license to host, process, transform, transmit, and generate Output from Customer Data to:

  • provide the service;
  • security and abuse prevention;
  • legal compliance; and
  • training/improvement (Section 7), unless applicable opt-out.

The customer represents and warrants that they have the legal basis and rights to provide Customer Data and allow its processing according to these Terms.

7. Training with Customer Data + opt-out

By default, Datachaser may use Customer Data and Outputs to train and improve service models and components.

7.1 Opt-out (Enterprise / by agreement)

Eligible customers may request opt-out in writing, subject to an addendum. If opt-out is active:

  • Datachaser will not use that data for training/improvement,
  • but may process it to provide the service, security, abuse prevention, and legal compliance.

8. Scraping/extraction from third parties

If the customer uses Datachaser to extract/enrich from third-party sites or sources:

  • the customer is responsible for complying with terms, licenses, robots, and applicable laws;
  • Datachaser does not guarantee continuous access or absence of blocks by third parties;
  • Datachaser may impose restrictions to prevent abuse and risks.

9. Providers and Third Parties

Datachaser uses AWS, Stripe, Datadog, and Google Workspace. The customer acknowledges that integrations and third-party services are governed by their own policies.

10. Confidentiality

Each party will protect confidential information with reasonable care and use it only for the contractual relationship, except by legal obligation.

11. Warranty Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". DATACHASER DOES NOT GUARANTEE OUTPUT ACCURACY, ABSENCE OF ERRORS, OR UNINTERRUPTED AVAILABILITY.

12. Limitation of Liability (healthy limit for startup)

TO THE EXTENT PERMITTED BY LAW:

  • Datachaser will not be liable for indirect, incidental, special damages, lost profits, data loss, or reputation damage.
  • Datachaser's total aggregate liability, arising from or related to the service, will not exceed THE GREATER of:
  • the amount paid by the customer to Datachaser in the 12 months prior to the event giving rise to the claim; and
  • USD $1,000.

Some jurisdictions do not allow certain limitations; in such cases, the minimum permitted will apply.

13. Indemnification

The customer will indemnify Datachaser for third-party claims arising from:

  • Customer Data without legal basis or that infringes rights;
  • violation of third-party laws/terms (incl. scraping);
  • use of Output in an illegal or harmful manner.

14. Suspension and Termination

We may suspend or terminate for breach, security risk, or legal obligation. Retention/deletion is governed by the Privacy Policy, DPA, and applicable agreements.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Delaware, excluding conflict rules. Exclusive jurisdiction in state or federal courts located in Delaware.
